Consumer rights - injunction for unfair contract terms Power
- Description
- A local authority may apply for an injunction against a person if the regulator thinks that—
(a) the person is using, or proposing or recommending the use of, a term or notice to which this Schedule applies, and
(b) the term or notice purports to exclude or restrict liability of the kind mentioned in sections 31, 47, 57 or 65(1) or is unfair or does not meet the transparency test.
The CMA must be notified of any such application and its outcome.
