Special educational needs - continued provision where EHC plan maintained Power

Description
This section applies where, immediately before a child in need reaches the age of 18—

a local authority in England is providing services for the child in the exercise of functions conferred by section 17, and
an EHC plan is maintained for the child.

The local authority may continue to provide services for the child in the exercise of those functions after the child reaches the age of 18, but may not continue to do so after the EHC plan has ceased to be maintained.

In this section “EHC plan” means a plan within section 37(2) of the Children and Families Act 2014.
