- Before giving notice requiring a further education institution to provide education for a named individual, a local authority must consult the governing body of the institution, and such other persons as the authority think appropriate.
In deciding whether to require a particular institution to provide education to a particular individual a local authority in England must have regard to any guidance given from time to time by the Secretary of State
