- This is the total number of Special Educational Needs and Disability mediation cases that went on to appeal in the year.
Parents or young people who wish to register an appeal to the First-tier Tribunal (Special Educational Needs and Disability) may do so only after they have contacted an independent mediation adviser and discussed whether mediation might be a suitable way of resolving the disagreement. After receiving information, it is for the parents and young person to decide whether to take part in mediation or appeal to the Tribunal without taking part in mediation. If they decide to take part in mediation, once it has finished they can then decide whether or not to appeal to the Tribunal. These arrangements do not apply when the appeal is solely about the name of the school, college or other institution named in the EHC plan, the type of school, college or institution or the fact that no school, college or institution is named.
The appealable decisions are: refusal to carry out an EHC needs assessment (and refusal to reassess); refusal to issue an EHC plan; refusal to amend an EHC plan following a review or reassessment and a decision to cease to maintain an EHC plan. There are also rights of appeal about the contents of an EHC plan which can be about: (i) The child or young person's special educational needs; (ii) The special educational provision specified in the EHC plan; (iii) The school or other setting named in the EHC plan or the type of school or setting; (iv) If no school or other setting is named, that fact.
Education, Health and Care (EHC) plans were introduced from September 2014 as part of a range of SEND reforms. A pupil has a statement of SEN or an EHC plan when a local authority issues one following a formal assessment. This document sets out the child's needs and the extra help they'should receive. Statements of SEN were issued for children aged 0-19, EHC plans were extended to cover children and young people aged 0-25.
